Governing lawLaws of the Kingdom of Saudi Arabia

1. Our Services

Alrakeen provides IoT and technology solutions including fleet management systems, temperature monitoring, data center infrastructure, security systems, and an IoT management platform, delivered to businesses and institutions operating in the Kingdom of Saudi Arabia. Specific service scope, service levels, and pricing for any engagement are set out in a separate signed agreement or order form between Alrakeen and the client, which forms part of these Terms for that client.

2. Eligibility and Website Use

Our website and general marketing content are intended for business use. You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the website by, any third party. You must not attempt to gain unauthorized access to any part of our systems, interfere with the security of our website, or use automated means to scrape or extract content without our prior written consent.

3. Client Agreements Prevail

Where Alrakeen and a client have entered into a separate service agreement, master services agreement, or purchase order, the terms of that signed agreement govern the specific services provided and take precedence over these Terms in the event of any conflict. These Terms apply generally to website use and to any matters not otherwise addressed in a signed agreement.

4. Intellectual Property

All content on this website, including text, graphics, logos, product names, software, and platform interfaces, is the property of Alrakeen or its licensors and is protected under applicable Saudi and international intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand assets without our prior written permission.

5. Device and Platform Use

Where IoT devices, tracking hardware, or platform access are provided as part of a service engagement, clients and their authorized users are responsible for using such devices and platforms in accordance with the applicable service agreement, our usage guidelines, and all relevant Saudi laws and regulations, including those administered by the Communications, Space & Technology Commission (CST) and, where applicable, the Saudi Food and Drug Authority (SFDA) for regulated device categories.

6. Data Protection

Our collection and processing of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference and reflects our obligations under the Saudi Personal Data Protection Law.

7. Fees and Payment

Fees for services are as set out in the applicable client agreement or quotation. Unless otherwise agreed in writing, invoices are payable in Saudi Riyals (SAR) within the payment terms specified in the relevant agreement. Late payment may result in suspension of services in accordance with the terms of that agreement.

8. Limitation of Liability

To the maximum extent permitted under the laws of the Kingdom of Saudi Arabia, Alrakeen shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the use of our website or services, except where such liability arises from our willful misconduct or gross negligence. Nothing in these Terms limits any liability that cannot be excluded or limited under applicable Saudi law.

9. Warranties and Service Levels

Specific warranties, uptime commitments, and service levels applicable to a given engagement are defined in the relevant client agreement or service level agreement (SLA). Except as expressly stated in such an agreement or as required by applicable law, our website and general service descriptions are provided "as is" without warranties of any kind.

10. Termination

We may suspend or restrict access to our website at our discretion, including where necessary to protect the security or integrity of our systems. Termination of a specific service engagement is governed by the termination provisions of the applicable client agreement.

11. Governing Law and Jurisdiction

These Terms are governed by the laws and regulations of the Kingdom of Saudi Arabia. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Kingdom of Saudi Arabia, unless a separate client agreement specifies an alternative dispute resolution mechanism.

12. Changes to These Terms

We may revise these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of our website after changes take effect constitutes acceptance of the updated Terms.
